Justice Denied: Parents Devastated as No One Held Accountable for Disabled Son’s Death

  • The Aftermath: By the time staff checked him at 8:00 PM, he was slurring his words, unable to move, and had urinated in his bed. He died in the ICU after emergency surgery failed to save him.

Despite the HDC’s findings, the path to justice has been blocked by bureaucratic thresholds:

  • Police & WorkSafe: Both agencies have refused to investigate, claiming the death does not meet the “threshold for criminal negligence” or that it was a matter of “clinical care.”
  • The “Secret Deal”: Jacob’s mother, Jo Davies, discovered that the HDC offered NZCL an “expedited” pathway. In exchange for accepting a single breach, the provider was not referred for prosecution and was initially not named in the final report.
